Wild West Triggers Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the Wild West Triggers website at www.wildwesttriggers.com (the “Site”) and your purchase of clothing, apparel, headwear, and related lifestyle accessories offered through the Site (collectively, the “Products”). In these Terms, “Wild West Triggers,” “we,” “us,” and “our” refer to Wild West Triggers, and “you” and “your” refer to the person accessing the Site or purchasing Products.
Please read these Terms carefully. By accessing the Site, creating an account, or placing an order, you agree to be bound by these Terms and by the policies referenced in them, including our Privacy Policy, Shipping Policy, and Return and Refund Policy. If you do not agree, do not use the Site or place an order.
1. Eligibility and Account Responsibilities
You must be legally capable of entering into a binding contract in your jurisdiction to make a purchase through the Site. If you are under the age of majority where you live, you may use the Site only with the involvement and permission of a parent or legal guardian.
You may be permitted to create an account. You agree to provide accurate, current, and complete information and to keep your login credentials confidential. You are responsible for activity conducted through your account. Notify us promptly at info@wildwesttriggers.com if you believe your account or payment information has been used without authorization.
We may suspend or terminate an account, refuse service, or cancel an order when reasonably necessary to prevent fraud, protect the Site or other users, enforce these Terms, or comply with applicable law.
2. Apparel and Lifestyle Products
These Terms are written for the sale of Wild West Triggers clothing, apparel, headwear, and related lifestyle accessories. Brand names, slogans, graphics, firearm imagery, and Second Amendment-themed designs appearing on apparel are expressive or decorative elements. Unless a product page expressly states otherwise, apparel and lifestyle Products are not firearms, ammunition, firearm components, protective equipment, or safety equipment.
Product availability, styles, colors, materials, sizing, specifications, packaging, and prices may change without notice. Changes will not affect an order we have already accepted unless we contact you and obtain any consent required by law.
3. Product Descriptions, Images, and Sizing
We make reasonable efforts to describe and display Products accurately. However, screen settings, photography, lighting, manufacturing methods, fabric batches, and printing or embroidery processes may cause colors, placement, texture, and other details to appear slightly different from the Product received.
Sizing may vary by style or manufacturer. You are responsible for reviewing the size chart and Product description before ordering. Minor variations that do not materially affect a Product’s intended use are not considered defects.
If a Product is materially different from its description, damaged, defective, or incorrect when delivered, contact us promptly and follow the procedures in our Return and Refund Policy.
4. Orders and Acceptance
Your order is an offer to purchase the Products listed in the order. An automated order confirmation only acknowledges that we received your order; it does not necessarily mean that we have accepted it. We may accept an order by sending a shipment confirmation or otherwise beginning fulfillment.
We reserve the right to reject, limit, or cancel an order for legitimate reasons, including suspected fraud, pricing or listing errors, inventory shortages, payment problems, shipping restrictions, suspected resale activity, or violations of these Terms. If we cancel an order after payment has been collected, we will refund the canceled amount to the original payment method, subject to applicable law and payment-provider processing times.
Once fulfillment begins, we may be unable to change or cancel an order. Contact us as soon as possible if you need to request a change. We do not guarantee that a requested change can be made.
5. Prices, Payments, Promotions, and Taxes
Prices are displayed in U.S. dollars unless otherwise stated. Product prices generally do not include shipping charges, taxes, duties, or other charges, which will be shown at checkout when applicable.
By submitting payment information, you represent that you are authorized to use the selected payment method and authorize us and our payment processors to charge the total amount shown at checkout. Payment must be approved before an order is fulfilled.
You are responsible for applicable sales, use, excise, customs, import, and similar taxes or charges, except for taxes imposed on our income. We may collect and remit taxes when required by law.
Promotional offers, discount codes, and sale prices may be subject to separate conditions, expiration dates, exclusions, and quantity limits. Unless expressly stated otherwise, promotions cannot be combined, applied retroactively, redeemed for cash, or transferred. We may correct or cancel a promotion affected by fraud, abuse, or an obvious error.
6. Shipping and Delivery
Shipping options, estimated fulfillment times, rates, and available destinations are provided on the Site or during checkout. Delivery dates are estimates unless we expressly state that a date is guaranteed.
You are responsible for providing a complete and accurate recipient name, shipping address, email address, and telephone number. Additional charges caused by an incorrect or incomplete address may be your responsibility to the extent permitted by law.
We use third-party carriers and fulfillment providers. Orders may arrive in separate packages. If we cannot ship within the time stated at checkout or, when no time is stated, within the period required by applicable law, we will provide any notice, cancellation option, or refund required by law.
Risk of loss and title transfer as provided by applicable law. Nothing in these Terms limits rights you may have for Products lost or damaged in transit. If tracking shows a delivery that you did not receive, or if a package appears lost or damaged, contact us promptly at info@wildwesttriggers.com or 888-794-8849 so we can review the matter and, when appropriate, assist with a carrier claim.
We are not responsible for delays caused by events outside our reasonable control, but this does not limit any non-waivable rights or remedies available to you under applicable law.
7. Returns, Exchanges, and Refunds
Returns, exchanges, and refunds are governed by the Return and Refund Policy posted on the Site at the time of purchase, which is incorporated into these Terms.
Unless the Return and Refund Policy or applicable law provides otherwise:
Products must be returned in their original condition, unworn, unwashed, and with original tags attached.
Proof of purchase may be required.
Final-sale, clearance, personalized, custom-made, or hygiene-sensitive Products may be nonreturnable when clearly identified before purchase and when permitted by law.
Original shipping charges and return-shipping costs may be nonrefundable unless the Product was damaged, defective, incorrect, or applicable law requires otherwise.
Approved refunds are generally issued to the original payment method. Financial institutions may require additional processing time.
Do not send a return without first following the instructions in the Return and Refund Policy or contacting us. Nothing in these Terms or our Return and Refund Policy limits any non-waivable consumer rights.
8. Intellectual Property
The Site and its contents—including the Wild West Triggers name, logos, slogans, artwork, photographs, graphics, product designs, text, videos, layout, and software—are owned by or licensed to Wild West Triggers and are protected by trademark, copyright, and other intellectual-property laws.
We grant you a limited, revocable, nonexclusive, nontransferable license to access and use the Site for personal, lawful shopping purposes. You may not copy, reproduce, modify, distribute, sell, license, create derivative works from, scrape, or commercially exploit Site content without our prior written permission or another lawful basis.
Purchasing a Product does not transfer ownership of any trademark, copyright, logo, artwork, or other intellectual property displayed on the Product.
9. Reviews, Photos, and Other User Content
If you submit a review, photograph, comment, testimonial, suggestion, or other content (“User Content”), you retain any ownership rights you have in that content. You grant Wild West Triggers a nonexclusive, worldwide, royalty-free, sublicensable license to host, reproduce, display, distribute, adapt, and use the User Content in connection with operating, improving, and promoting our business and Products, subject to applicable law and our Privacy Policy.
You represent that you have the right to submit the User Content and that it is accurate and does not violate another person’s privacy, publicity, copyright, trademark, or other rights. You may not submit content that is unlawful, fraudulent, threatening, defamatory, obscene, malicious, discriminatory, or harmful, or that contains malware, unauthorized advertising, or another person’s confidential information.
We may remove or decline to publish User Content, but we are not obligated to monitor all User Content. If your content includes personal information, our handling of that information is also governed by our Privacy Policy.
10. Acceptable Use of the Site
You may not use the Site to:
Violate any applicable law or another person’s rights;
Commit or attempt fraud, impersonation, payment abuse, or unauthorized access;
Introduce viruses, malicious code, automated attacks, or technology intended to disrupt the Site;
Scrape, crawl, harvest, or collect information through unauthorized automated means;
Interfere with the Site’s operation, security, or other users;
Circumvent purchase limits, access controls, or security measures; or
Use our branding or Site content in a misleading manner or in a way that suggests an unauthorized affiliation or endorsement.
We may investigate suspected violations and cooperate with law enforcement or service providers when legally permitted or required.
11. Third-Party Services and Links
The Site may rely on or link to third-party services, including payment processors, shipping carriers, social-media platforms, and other websites. We do not control and are not responsible for the independent content, security, availability, or privacy practices of third parties. Your use of a third-party service may be governed by that party’s own terms and policies.
12. Privacy and Electronic Communications
Our Privacy Policy explains how we collect, use, and disclose personal information. By using the Site, you acknowledge that policy.
You agree that we may send transactional communications electronically, including order confirmations, receipts, shipping updates, policy notices, and customer-service messages. Marketing communications are subject to applicable law, and you may unsubscribe using the instructions included in those messages. Unsubscribing from marketing does not prevent necessary transactional communications.
13. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WILD WEST TRIGGERS DISCLAIMS ALL WARRANTIES NOT EXPRESSLY STATED IN THESE TERMS OR REQUIRED BY LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SITE WILL ALWAYS BE AVAILABLE, SECURE, OR ERROR-FREE, OR THAT PRODUCT IMAGES WILL APPEAR IDENTICALLY ON EVERY DEVICE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OR ALL OF THIS SECTION MAY NOT APPLY TO YOU.
Nothing in these Terms excludes or limits an express product warranty or a warranty, guarantee, right, or remedy that cannot legally be excluded.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WILD WEST TRIGGERS AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATING TO THE SITE, PRODUCTS, OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES MAY OCCUR.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR A CLAIM ARISING FROM OR RELATING TO A PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THAT PRODUCT, AND OUR TOTAL LIABILITY FOR ANY OTHER CLAIM ARISING FROM OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO US DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These limitations do not apply to liability that cannot legally be excluded or limited. Because some jurisdictions do not allow certain exclusions or limitations, portions of this section may not apply to you.
15. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Wild West Triggers and its owners, officers, employees, contractors, agents, affiliates, and service providers from third-party claims, damages, liabilities, judgments, costs, and reasonable attorneys’ fees arising from your unlawful use of the Site, your material breach of these Terms, your User Content, or your violation of another person’s rights.
This obligation does not require you to indemnify any party for that party’s own fraud, willful misconduct, or other conduct for which indemnification is prohibited by law.
16. Governing Law and Disputes
These Terms and any dispute arising from them, the Site, or a Product purchase are governed by the laws of the State of Arizona, without regard to conflict-of-law principles, except to the extent another jurisdiction’s mandatory consumer-protection laws apply.
Before filing a lawsuit, you and Wild West Triggers agree to make a good-faith effort to resolve the dispute informally. Send a written description of the issue and requested resolution to info@wildwesttriggers.com. We will use reasonable efforts to respond.
Unless applicable law requires otherwise, any court proceeding must be brought in a state or federal court with jurisdiction in Arizona, and each party consents to the jurisdiction of those courts. Either party may bring an eligible individual claim in small-claims court. Nothing in this section prevents either party from seeking urgent injunctive relief to protect intellectual property, confidential information, or Site security.
17. Changes to the Site and These Terms
We may update the Site, Products, policies, and these Terms from time to time. Updated Terms become effective when posted with a revised “Last updated” date, unless a later date is stated. Changes will apply prospectively and will not alter an accepted order in a manner prohibited by law.
Your continued use of the Site after updated Terms take effect constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, stop using the Site.
18. Termination
You may stop using the Site at any time. We may suspend or terminate access to the Site if you materially violate these Terms, create security or legal risk, engage in fraudulent activity, or misuse our services.
Provisions that by their nature should survive termination—including intellectual-property rights, warranty disclaimers, limitations of liability, indemnification, governing law, and dispute provisions—will survive.
19. General Provisions
These Terms and the policies incorporated by reference constitute the entire agreement between you and Wild West Triggers concerning the Site and apparel Product purchases, except for any separate written agreement that expressly applies.
If a provision of these Terms is found unenforceable, it will be modified only to the minimum extent necessary or severed, and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, financing, corporate reorganization, sale of assets, or transfer of the business, subject to applicable law.
We are not liable for a delay or failure caused by events beyond our reasonable control, including natural disasters, severe weather, war, civil unrest, labor disruptions, government action, epidemics, carrier interruptions, supply shortages, utility outages, or internet and telecommunications failures. This provision does not excuse payment obligations or limit rights that cannot be waived by law.
